Liability waiver

4KS (hereinafter “the Organiser”) organises the 4KS rally (hereinafter “the Event”).

The various parties directly or indirectly involved in organising the Event (hereinafter “the Organisers in the broad sense”) include, by way of example and without limitation:

• the non-profit 4KS (VZW), its directors, associates, consultants, representatives, hosts and hostesses or volunteers;
• any company, sponsor or organisation connected with the Event.

The Event includes in particular a scenic route on which participants set off and arrive according to their own abilities. If necessary, they may leave the proposed route at any time, for example because of roadworks, traffic jams, weather conditions, diversions or other disruptions, or simply if they wish to do so.

This route is in no way a race or a speed competition.

By taking part in the Event, the undersigned irrevocably accept the following conditions. In their own name and on behalf of each member of their family and their heirs, they unconditionally and definitively acknowledge, warrant, undertake and declare:

• that they take part entirely at their own risk;
• that they waive any claim and any right to compensation against the Organisers in the broad sense for any material or non-material damage or bodily injury, including death, whether or not resulting from their own fault, error, recklessness or negligence;
• that they hold the Organisers in the broad sense harmless from any liability in the event of loss, theft or damage to property, including vehicles, during the Event;
• that they will follow the organisers’ instructions at all times during the Event, and that the organisers may exclude a participant from the remainder of the Event without giving reasons and without refunding the registration fee;
• that they will comply with the law and with all road traffic legislation and regulations, and will behave appropriately;
• that they will observe all safety instructions, both behind the wheel and at the Event venues;
• that they will at all times remain solely responsible for the persons in their care or whom they accompany, or will stand as guarantor for them.

The undersigned shall at all times and on first demand indemnify the Organisers in the broad sense against any damage, whether principal or ancillary, for which the latter may be held liable or which they may be ordered to pay.

The undersigned declare that they have understood the content of this document.

This document is governed by Belgian law.
